Definitions

"Customer" means any person who purchases the Service via a phone app.

"Service" means the Quickflight.mobi Travellers Information Service (TIS)  through which Quickflight.mobi provides information to the Customer with respect to flight departure and arrival information from and/or to any airport serviced by Quickflight.mobi by viewing notifications and alerts via phone app or weblet by the Customer.

2.         Applicability and Quickflight.mobi TIS agreement

2.1       These General Terms and Conditions shall apply to all agreements entered into between Quickflight.mobi and a customer engaging in Quickflight.mobi's service through this website or through any other means of communication.

3.         Offer

3.1       The Service offered by Quickflight.mobi through its website is offered on the terms and conditions set out herein.

4.         Disclaimer

4.1       The materials in this site are provided "as is" and without warranties of any kind either express or implied.  To the fullest extent permissible and subject to applicable law, Quickflight.mobi disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.  Quickflight.mobi does not warrant that the functions contained in the materials will be uninterrupted or error free, that defects will be corrected or that this site or the server that makes it available is free of any virus or other harmful elements.  Quickflight.mobi does not warrant or make any representations regarding the correctness, accuracy, reliability or otherwise of the materials in the site with the results of their use.

5.         Acceptance

5.1       The customer is offered the opportunity to enter the data required for the Service via the website or phone app and to make a selection from the various options available as part of the Service.

6.         Prices and payment

6.1       The prices stated on the Quickflight.mobi TIS website are inclusive of any applicable taxes and are stated in New Zealand dollars or alternatively in Australian, United States, United Kingdom or Euro currencies.

6.2       Payment shall be effected only via the methods offered on the Web Site providing the phone app.

7.        Availability

7.1       Quickflight.mobi shall not be liable for the lack of provision of the Services, where the Customer fails to receive a message are due to circumstances beyond Quickflight.mobi's control including the following:

• the unavailability of the necessary data connections;

• the poor performance of the necessary networks (including internet and the mobile telephone network), servers and operator switchboards, including interconnection capacity problems and full occupation of call-in numbers or technical interfaces;

• defects in the Customer's software and/or hardware;

• the availability of the means of communication designated by the Customer (including the means of communication being disconnected and/or the message memory being fully filled);

• power failure; and

• where incorrect communication details have been provided by the Customer.

7.2       Quickflight.mobi shall be entitled to make changes or improvements to its Service and/or its systems without giving the Customer prior notice. The Customer shall be notified where possible of any changes or improvements which, in the reasonable opinion of Quickflight.mobi, require considerable adjustment of the hardware and/or software used by the Customer, at least one month prior to the implementation of such change or improvement.

7.3       Quickflight.mobi shall, without prior notice, be entitled to put the systems out of operation temporarily or otherwise and/or to restrict their use, insofar as this is required for the reasonable maintenance of such system

7.4       Quickflight.mobi shall not be liable for any damage that may be suffered by the Customer as a result of the provisions of this clause 7.

8.       Complaints

8.1     If a Customer has a complaint with respect to the product or the agreement, irrespective of the nature of the complaint, the Customer shall notify in writing to the Customer Contact Centre within 14 days.  The Customer Contact Centre shall either handle the complaint itself, or if there is any reason pass the complaint to a third party for handling.

9.       Personal data

9.1     Quickflight.mobi shall collect the personal data filled in by the Customer on the application form with respect to the Service, data regarding his clicking and surfing behaviour and transactions via the Quickflight.mobi Web Site. Quickflight.mobi shall comply with the statutory provisions set out in the Privacy Act 1993. Customers personal details will not be sold to any third party.

9.2     The Customer's data shall be filed in a customer file and shall be used for processing the order or booking, including payment and customer service. Quickflight.mobi shall also use the data to analyse the Customer's clicking and surfing behaviour as well as the Customer's transactions and, hence, make customer profiles. Quickflight.mobi will use these profiles to refine the range of products and services on the Web Site and to be able to make the Customer customised offers from Quickflight.mobi's total product and service range. At the request of third parties within Quickflight.mobi Group, Quickflight.mobi may carry out marketing activities using the Customer's address data unless the Customer does not consent to such use.

10.       Liability

10.1     Quickflight.mobi does not accept any liability for not rendering a service if a service is not paid for, or for data entered incorrectly by the Customer, or for any other circumstances beyond its control.

10.2     To the extent Quickflight.mobi is liable for any damage pursuant to mandatory provisions, its liability shall be limited to the amount paid by the Customer for the Quickflight.mobi TIS.

11.       Choice of law and dispute resolution

11.1     This agreement shall be governed by New Zealand law.

11.2     If any dispute arises between the parties, they shall mutually try to settle the matter amicably before submitting the dispute to a New Zealand Court.

12.       Intellectual Property Rights

12.1     This site is owned and operated by Quickflight.mobi.  No material from this site may be reproduced, republished, uploaded, posted, transmitted or distributed in any way without the prior written permission of Quickflight.mobi, except that the Customer may download one copy of the material on a single computer for the Customer's own domestic use only, provided accompanying copyright and other proprietary notices are kept intact.  Modification of any of the materials or use of the materials for any other purpose will be in violation of Quickflight.mobi's copyright and other intellectual property rights.

12.2     If the Customer downloads any software from this site, including any files, images, code and data ("the software"), the software is licensed to the Customer by Quickflight.mobi.  Quickflight.mobi does not transfer title to the software to the Customer.  The Customer owns the medium on which the software is recorded, but Quickflight.mobi retains full and complete title to the software and all intellectual property rights therein.  The Customer may not redistribute, sell, decompile, reverse engineer, disassemble or otherwise deal with the software.

13.       Restricted Use

13.1     The Customer may not use this site to make speculative, false or fraudulent enquireies.  The Customer may not use any device, including any software or routine, which interferes with the normal operation of this site or take any action that imposes an unreasonable load on Quickflight.mobi's servers or other computer equipment or the computer equipment of Quickflight.mobi's internet service providers.  The Customer may not use any software, programme, algorithm, methodology or other automatic device, including any spider, robot or otherwise, to monitor, copy, collect or harvest any data, information or content found on this site or use any manual processor for the same purpose.

13.2     The Customer may not use the Quickflight.mobi TIS for commercial lookups or for third parties in any commercial form. This site is purely for personal use. If a customer wishes to enter into an agreement with Quickflight.mobi for the commercial use of the Quickflight.mobi TIS they should contact sales@verifyflight.com.

14.       Third Party Offers

14.1     This site may include third party material, advertising, promotions and/or links to third party materials.  Any dealings the Customer has with a third party provider is solely between the Customer and that third party.  To the extent that Quickflight.mobi assists the Customer in dealings with a third party, Quickflight.mobi is acting purely as an agent for the relevant third party.  While Quickflight.mobi has taken reasonable care to ensure that third parties are reputable, Quickflight.mobi will not be responsible for the contents of any third party material or promotion or be liable for any direct or indirect loss or damage suffered by the Customer (or any other party) accessing, using, relying on or trading with third parties.  The inclusion of any link or third party material, advertising or promotion does not imply Quickflight.mobi's endorsement of or any association with the third party.
